DoT has decided to seek legal opinion on the issue of 2G spectrum allotment beyond 4.4 MHz to operators. This decision was taken since its options in the matter were restricted due to a pending decision of the Spectrum Panel report and an order from the Telecom Disputes Settlement and Appellate Tribunal (TDSAT), both of which are against the current subscriber-linked spectrum allocation norm. In March 2009, TDSAT categorised spectrum allocated beyond 6.2 MHz as illegal. Meanwhile, the Ministry of Finance has asked the department to stop any fresh allocation of 2G spectrum until a final view is taken on the recommendations of the Spectrum Panel Committee on the quantum of spectrum allocation and pricing.
