The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has upheld the dual-spectrum allocation policy of DoT, issued in 2007, that allowed CDMA players to get GSM spectrum. After the telecom policy was amended, GSM operators had moved TDSAT, but it turned down their plea, stating that DoT's order has not impacted the level playing field. TDSAT has also rejected GSM operators' contention that they had the right to hold spectrum up to 15 MHz and that DoT had allowed CDMA operators to make payments for launching GSM services even before the government had unveiled the dual technology policy. It also concurred with DoT's decision to turn down TRAI's recommendation that dual technology licence holders pay spectrum usage charges on their combined spectrum.
