The Delhi Court has asked Sistema Shyam TeleServices Limited (SSTL) to modify its advertisement which claims that MTS provides internet speed up to 9.8 mbps. The judgment has come after SSTL filed a petition against Advertising Standards Council of India's (ASCI) order which had asked the telecom company to either suspend or modify its advertisement by December 10, 2014.
According to ASCI, the advertisement is misleading and it is probable that any person reading or viewing the advertisements containing the aforesaid claims may not be able to assess that such speeds are available only in ideal conditions.
With its decision, Delhi High Court has declined SSTL’s plea to set aside ASCI’s judgement. It has also directed ASCI to ensure that a uniform policy of examining advertisements is followed so that the same criterion is applied to judge other service providers as well.
